What is the role of the Commonwealth Ombudsman in complaints about Freedom of Information matters?

FOI complaints are handled by the OAIC. However, the Commonwealth Ombudsman can investigate a complaint about action taken by an agency under the FOI Act, particularly where it would be more appropriate for the Ombudsman to investigate. The Ombudsman must consult with the Information Commissioner before deciding to investigate a complaint about a matter in certain circumstances. If the Ombudsman decides not to investigate a complaint, the Ombudsman must transfer the complaint and all relevant documents and information to the Information Commissioner. See Part 11 of the Guidelines.

For more information about the Commonwealth Ombudsman, see the Commonwealth Ombudsman's website.
