Privacy fact sheet 47: Young people and the My Health Record system (Northern Queensland and Nepean Blue Mountains)

In June 2016, people whose registered Medicare address is in the Northern Queensland or Nepean Blue Mountains Primary Health Networks will have a My Health Record created for them. This includes young people under the age of 18. This fact sheet explains how young people can take control of and manage their My Health Record, and how an authorised representative (such as a parent) can manage a My Health Record on a young person’s behalf. This includes how to opt a young person out of a My Health Record so that a record is not created for them.

This fact sheet is for people whose registered Medicare address is in the Northern Queensland and Nepean Blue Mountains Primary Health Networks. It should be read together with the OAIC’s Privacy fact sheet 46: My Health Record system — What to expect in Northern Queensland and Nepean Blue Mountains.

What is a My Health Record?

A My Health Record is an online summary of your health information, such as medicines you are taking, any allergies you may have and treatments you have received. It was previously known as a Personally Controlled Electronic Health Record (PCEHR) or eHealth record.

Your My Health Record allows your doctors, hospitals and other healthcare providers (such as physiotherapists) to view your health information, in accordance with your access controls. You are also able to access it online yourself.

In most parts of Australia you need to actively register for a My Health Record. However, people whose registered Medicare address is in Northern Queensland or the Nepean Blue Mountains will have a My Health Record automatically created for them by the Australian Government. If you are registered as living in either of these areas and don’t want a My Health Record, you will need to opt-out by 27 May 2016.

You can use the postcode checker on the My Health Record website to see if your registered Medicare address is in one of these areas. If it is in one of these areas you should also receive a letter and brochure from the Australian Government with further information.

Information for parents and guardians

Having a My Health Record created for your child

A My Health Record will be created for any children listed on your Medicare Card who are also registered by Medicare as living in Northern Queensland or the Nepean Blue Mountains area. If you are a guardian, dependents who are not listed on your Medicare Card but are registered by Medicare at the same address as you will also have a My Health Record created. However, you do have the option of opting-out and not having a My Health Record created for your child or dependent if you do not want one.

If you do not want a My Health Record created for your child or any dependents you have, you will need to opt-out by 27 May 2016.

Managing a child’s My Health Record

If you do have a My Health Record created for your child or a dependent, you will be listed as their ‘authorised representative’. You will be responsible for managing their My Health Record until they turn 18 or take control of it. A child can take control of their My Health Record from the age of 14 if they choose.

Managing a child’s My Health Record includes determining which healthcare providers may access it and whether any other people (including the child) may access it. More than one authorised representative can manage a child’s My Health Record (for example, both parents of the child may be authorised representatives).

If a young person lacks capacity to make their own decisions, an authorised representative can continue to manage their My Health Record after they turn 18. If you need to apply to be an adult’s authorised representative, you will need to provide evidence to Medicare that the adult lacks capacity to make their own decisions, and that you are authorised by law or are an appropriate person to act on their behalf. Medicare information included in a child’s My Health Record

When a My Health Record is created for a child or young person you can decide whether Medicare information is included in their My Health Record. If you do not want Medicare information to be uploaded to their record, you will need to set their Medicare preferences by 14 July 2016.

When the child turns 14 any Medicare information included in their My Health Record will no longer be accessible to you. This is in line with existing Medicare policy to keep this information private from parents or others without the express consent of the young person.

Medicare information will only be made available again if the child takes control of their record and consents to the inclusion of this information.

Information for young people

As your registered Medicare address is in Northern Queensland or the Nepean Blue Mountains, a My Health Record will be created for you. However, you do have the option of opting-out and not having a My Health Record created for you if you don’t want one.

To do this you can:

If you do not want a My Health Record you, you will need to opt-out by 27 May 2016.

When you do this you will need to verify your identity. For more information about how your personal information will be handled for this purpose, please see the My Health Record privacy policy at www.myhealthrecord.gov.au/privacy.

If you are under 14 you can ask your parent or guardian to opt-out of having a My Health Record created for you. Alternatively, if you would like to do this yourself, you can go to a Medicare Service Centre with evidence that proves you have the capacity to make your own health decisions (such as a letter from your doctor), as well as information to prove your identity.

If you are over 14, you can ask your parent or guardian to opt you out of having a record. You can also inform Medicare yourself by going to a Medicare Service Centre, provided you can verify your identity.

Managing your My Health Record

Your parent(s) or guardian can manage your My Health Record on your behalf until you turn 18 but you can choose to manage it yourself from age 14. If your parent(s) or guardian keeps managing your My Health Record until you are 18, they will determine which healthcare providers can access it and whether you can access it.

When you turn 14

When you turn 14 you are presumed to have capacity to make decisions about your My Health Record. From this age you can take control of your existing record. If you choose to manage your own My Health Record, you can decide whether to allow your parent and/or legal guardian access as a nominated representative.

If you choose not to manage your My Health Record, your authorised representative will manage it until you turn 18.

Before you turn 14

If you are under 14 and would like to take control of your My Health Record, you will need to prove to Medicare that you can make decisions about your healthcare and manage your My Health Record. This will be determined on a case by case basis. Evidence for this could include documentation from your healthcare provider supporting your request.

How to take control of your My Health Record

To take control of your My Health Record you can:

Automatic cancellation of authorised and nominated representatives

When you turn 18 or take control of your My Health Record, the System Operator will cancel the access of all authorised and nominated representatives. If you wish to retain any representatives, you will need to set this up.
