Privacy laws change tomorrow

Important changes to the Privacy Act 1988 commence on 12 March 2014.

The changes include a new set of Australian Privacy Principles (APPs) that will regulate the handling of personal information by Australian Government agencies, businesses with a turnover of more than $3 million or those trading in personal information and all private health service providers.

OAIC and the ACMA: Telstra breaches privacy

The Office of the Australian Information Commissioner (OAIC) and the Australian Communications and Media Authority (the ACMA) have found Telstra breached privacy laws in related investigations. Between February 2012 and May 2013, the information of 15,775 Telstra customers from 2009 and earlier was accessible on the internet. This included the information of 1,257 active silent line customers.

Cyber attacks do not mean businesses are 'off the hook'

The Office of the Australian Information Commissioner has released a statement correcting recent media reports that have suggested that organisations that experience a data breach as a result of a cyber-attack or hack are ‘off the hook’ or won’t be held accountable for the exposure of personal information.

The Office of the Australian Information Commissioner (OAIC) has updated their Guide to conducting privacy impact assessments to take account of changes under privacy law reform. This updated guide is now available for public consultation.

The OAIC welcomes comments by close of business 28 March 2014.
