Subject: eHealth – submission on OAIC's mandatory data breach notification guide

Thank you for providing further opportunity for the Royal College of Pathologists of Australasia (the College) to provide feedback on the Mandatory Data Breach Notification guide.

The College is generally supportive of the Guide however has the following specific comments/queries.

  • The document appears to be quite complex and not particularly "user friendly".
  • Is there some reassurance that accidental data breaches, e.g during the implementation phase of the PCEHR, will be able to be notified as per the mandatory requirements without attracting the penalties described?
