Data matching exemptions register

The Guidelines on Data Matching in Australian Government Administration (data matching guidelines) aim to assist Australian Government agencies to use data matching as an administrative tool in a way that complies with the Privacy Act 1988 (Privacy Act) and is consistent with good privacy practice.

The data matching guidelines, which are issued under s 28(1)(a) of the Privacy Act, are voluntary but represent the Office of the Australian Information Commissioner’s view on best practice with respect to agencies undertaking data matching activities. In appropriate circumstances an exemption from specific requirements of the data matching guidelines can be granted.

Partner visa data matching program Department of Human Services (DHS) DHS sought an exemption to Guideline 6 of the Guidelines on Data Matching in Australian Government Administration 2014 and the requirement to notify individuals prior to the investigation. 23/12/2014 The exemption applies for a total period of three years from January 2015.
Contractor payments (2013-14, 2014-15 and 2015-16 financial years) data matching program Australian Taxation Office (ATO) The ATO sought an exemption to Guideline 7 of the Guidelines on Data Matching in Australian Government Administration 2014 so as to retain data for three years from receipt of all data files from source entities. 06/03/2015 The exemption is for a total period of three years from the date the ATO receives the data.

Program protocol for data matching with the Australian Transactions Reports and Analysis centre Department of Human Services (DHS) DHS sought an exemption Guideline 6 of the Guidelines on Data Matching in Australian Government Administration 2014 and the requirement to notify individuals prior to taking administrative action. 13/08/2015 DHS is exempt from the requirement to provide reasonable notice to individuals before taking administrative action in relation to this Program.
Credit and Debit card data matching program Australian Taxation Office (ATO) The ATO sought an exemption to Guideline 7 of the Guidelines on Data Matching in Australian Government Administration 2014 so as to retain data for five years from receipt of all data files from source entities. 11/09/2015 The exemption is for a total period of five years from the date the ATO receives the data.
Ride sourcing data matching program Australian Taxation Office (ATO) The ATO sought an exemption to Guideline 7 of the Guidelines on Data Matching in Australian Government Administration 2014 so as to retain data for three years from receipt of all data files from source entities. 30/09/2015 The exemption is for a total period of three years from the date the ATO receives the data.
Real Property transactions 1985-2017 data matching program Australian Taxation Office (ATO) The ATO sought an exemption to Guideline 7 of the Guidelines on Data Matching in Australian Government Administration 2014 so as to retain data for seven years from receipt of all data files from source entities. 5/07/2017 The exemption is for a total period of seven years from the date the ATO receives the data.
